1. Product Description

GoMo Chat is a fully HIPAA-compliant communication solution developed and owned by Gold Group Enterprises, Inc. dba GoMo Health® (GoMo Health). It enables in-the-moment, secure conversations between organizations and the populations they serve. Designed for professional and clinical environments, GoMo Chat facilitates compliant, real-time engagement that supports outreach, education, and coordinated care. Access to GoMo Chat is provided through a secure login portal made available to authorized clients and users only.

2. Acceptance of Terms

By clicking on the login banner and continuing to access the GoMo Chat systems, you acknowledge that you have received, read, and accepted these Terms and Conditions. Access to GoMo Chat is further governed by any applicable provisions within your organization’s contract with GoMo Health. If you do not agree to these Terms, do not access or use the system.

3. Monitoring and Revocation of Use

GoMo Health reserves the right to monitor, audit, and log all activity within GoMo Chat for compliance, security, and performance purposes. This includes, but is not limited to, message content, access times, usage patterns, and associated metadata.

GoMo Health retains sole discretion to revoke or restrict access to GoMo Chat at any time and without prior notice if it determines that use of the system:

  • Violates any applicable laws or regulations;
  • Breaches these Terms or the client’s contractual agreement;
  • Threatens the security or integrity of the system; or
  • Misuses any assets, intellectual property, or data hosted within GoMo Chat.

4. Ownership and Use of Assets

All intellectual property, platform infrastructure, and content assets within GoMo Chat are the sole property of GoMo Health or its licensors. Users may not replicate, distribute, reverse-engineer, or misuse any component of the system. Any data input by or communicated through GoMo Chat is subject to applicable privacy, HIPAA, and data protection standards.

5. Liabilities

GoMo Health:

GoMo Health makes commercially reasonable efforts to maintain the uptime, security, and performance of GoMo Chat. However, GoMo Chat is provided on an “as-is” and “as-available” basis without warranties of any kind, either express or implied. GoMo Health is not liable for:

  • Any Third-party provider interruption, delay, or failure in service;
    • Internet outages
    • Malicious attacks (e.g. denial-of –service)
  • Unauthorized access or data breaches resulting from user negligence;

Clients and Third Parties:

Clients are responsible for ensuring that all authorized users understand and comply with these Terms. GoMo Health is not liable for any actions, omissions, or data handled by third-party users on behalf of the their users or third-party agents. It is the client’s responsibility to ensure internal protocols and user access controls are in place and consistently enforced.

6. Modifications

GoMo Health may update these Terms and Conditions from time to time. Continued access to and use of GoMo Chat after such updates shall constitute acceptance of the revised Terms.
